There are two parts to a claim for damages. Firstly, there is the compensation you receive for your actual injury, for your pain and suffering and this is known as General Damages.

In addition to damages for your injury of the claim you can claim for any financial losses you have suffered which may include any of the following:

  • Loss of earnings
  • Travel Expenses
  • Care provided by friends or family
  • Treatment costs
  • Motorcycle repair costs
  • Motorcycle hire costs
  • Insurance excess
  • Damage to helmet, leathers etc
  • Storage Charges
  • Loss of Pension
  • Inability to use your motorbike

The majority of personal injury claims are settled without having to go all the way to a Court trial. However, there is a very minimal risk that your case would go all the way to trial. In our experience less that 3% of cases actually go to Court.

This is a very difficult question to answer as it depends on each individual case. If you have more minor injuries, which resolve very quickly, your case is likely to take less time than someone who has major injuries and takes months or even years to recover. As a guideline, a straight forward whiplash injury claim with a fully recovery, may take 4 months to conclude. We would be happy to give you more advice once we discuss your own individual claim with you.
